Employment Discrimination
Under Wisconsin law, it is illegal to engage in employment discrimination against any individual on the basis of age, race, creed, color, disability, marital status, sex, national origin, ancestry, arrest record, conviction record, military service, or use or nonuse of lawful products off the employer’s premises during nonworking hours." Sec. 111.321, Wis. Stats. Whether or not a person is hired, promoted, transferred, disclipined, denied a raise or discharged should have nothing to do with the color of a person's skin, race, religion or gender. Overtime Protection
Under the Fair Labor Standards Act ("FLSA") employers are required to pay all non-exempt employees overtime if they work more than 40 hours in a week. Many employers pay their employees a salary instead of a hourly wage, and then don't pay the employee overtime. Just because you are paid a salary does not mean you are exempt from overtime! To avoid the overtime provisions of the FLSA, an employee must be salaried and in an "exempt" position of employment. Some employers will have an employee record overtime time hours on "next week's timecard" to avoid paying overtime. Other employer's won't pay if you have to take work home at night, or will allow you to come in, or stay late, on your own time, to catch-up.
